Tabcorp has been refunded a total of A$83m by the Australian Taxation Office after the operator disclosed that a resolution had been reached regarding an ongoing dispute.

This related to the income tax treatment of payments for various licences and authorities, which Tabcorp had confidently declared had been paid to the Commissioner in full. Each proceeding brought by the taxpayers will be dismissed.

As part of the settlement, the ATO will return the aforementioned sum, which is said to represent 20 per cent of the disputed tax liabilities and interest.

However, the company will pay approximately $37m to The Lottery Corporation under the terms of a separation deed dated March 25, 2022.

This saw Tabcorp document the terms of a demerger of TCL, the unit that operates the Tatts Lotto and Keno business across Australia’s six states, from the group’s gaming and wagering division.

After first being disclosed in July 2021 following a “thorough and rigorous assessment of all relevant structural and ownership options”, the aim was to forge two standalone ASX-listed companies, with distinct operating profiles, strategies and growth opportunities. 

As a result of its TLC payment, Tabcorp is set to recognise a benefit of approximately $45m after tax in its financial statements for the year ending June 30, 2024. This will be treated as a significant item. 

“The settlement also included an agreement in relation to how Tabcorp will treat future licence fees payable in respect of renewals of relevant existing licences,” the company updated.

“Subject to agreed limitations, Tabcorp must treat the fees as being of a capital nature. Tabcorp does not believe this will have any material effect on future results.”

Largest fine in Victoria

This comes off the back off Tabcorp being the latest target of regulator action within the Australian state of Victoria for a major system outage during the 2020 Spring Racing Carnival.

Last week, the Victorian Gambling and Casino Control Commission’s enforcement crusade continued with a A$1m fine being imposed on Tabcorp, the largest received by the company within the state.

Set against the backdrop of a 2021 royal commission and numerous recent financial sanctions and gambling reforms, the scale of the fine, the VGCCC said, reflects a failure to comply with directions to provide information concerning the issue. This left the group’s wagering and betting system unavailable for around 36 hours. 

Tabcorp suffered the outage on Saturday 7 November 2022, however, due to an obligation for the WBS to be continuously available, the Victorian Commission for Gambling and Liquor Regulation, the VGCCC’s predecessor, commenced an investigation.

The regulator noted that its directions were issued after the company was not voluntarily forthcoming with provision of adequate information concerning the outage.

Tabcorp has reiterated confidence in the group’s TAB25 vision that was rolled-out earlier in the year after achieving “what we pledged to investors we would do” during the year ending June 30, 2023. 

Speaking in the group’s latest annual report, Bruce Akhurst, Chair and Independent Non-Executive Director, and Adam Rytenskild, Managing Director and Chief Executive Officer, hailed the company for having laid the foundations for future growth.

In the first full year of operation following the demerger of the lotteries and keno business in June 2022, the pair detailed the launch of a new app, a record level of active customers at 805,000 and a level playing field in Queensland in helping to achieve its ongoing goals.

This latter point forms part of a wider ambition of ensuring that across every Australian state and territory, foreign owned online bookmakers licensed in the Northern Territory pay the same taxes and fees as Tabcorp. QLD subsequently joined the Australian Capital Territory and Tasmania, with Victoria set to follow suit next year and a review being undertaken in New South Wales.

In addition, Tabcorp is also aiming to progress with its TAB25 strategy, which level the playing field forms a part of, and is tasked with crafting a “simpler, growing, more valuable business, providing investors with clarity around our strategic goals for the next three years”.

Group results for the year highlight reported revenue of A$2.43bn, up 2.6 per cent year-on-year from A$2.37bn, net profit came in at A$66.5m compared to a loss of A$136.2m one year earlier, while EBITDA surged to A$407.4m (2021/22: A$216.3m). Capital expenditure came in at A$155.4m, with net debt standing at A$344.7m and undrawn debt facilities of A$950m.

Increases were reported across each of the core wagering and media and gaming services businesses, with the former seeing revenue and EBIT increase 2.2 per cent and 27.7 per cent to A$2.23bn (2021/2: A$2.18bn) and A$116.2m (2021/22: A$91m).

This is aligned to the impact of COVID-19 during the prior reporting period, which was partially offset by a decline in the digital wagering market, increased costs in “a highly competitive market” and ongoing investments.

Gaming services saw revenue jump 5.5 per cent to A$203.6m (2021/22: A$192.9m), with EBIT climbing to A$34.4m compared to the A$3.8m generated one year earlier. 

In addition to hailing a 20-year renewal across Tasmania that commenced on the first day following this reporting period, Tabcorp has put the performance down to a continue recovery from the pandemic, which was offset by select EGM contract non-renewals.

“FY23 benefited from gains on disposal of assets, an insurance recovery and the Genesis program, offset by dis-synergies from the demerger, inflation and cycling savings due to COVID restrictions in 1H22,” the company noted.

Looking ahead, Tabcorp says that a “strong performance on costs” will provide flexibility for continued investments through the next year, with the company expecting to set aside funding for a repositioning of the TAB brand, along with continued investment in data and analytics capability.

“We remain on track to deliver our TAB25 Opex target – this is a significant achievement given inflationary pressures and the investments we’re making,” Akhurst and Rytenskild continued.

“We’re making good progress on establishing a new operating model to enable more agile and contemporary ways of working. 

“We’re also investing in transforming our TAB venues to create a differentiated and more engaging in-venue customer experience and leverage our unique betting ecosystem.”

Light & Wonder’s 88 Fortunes has maintained its place at the top of the slots rankings in April’s Eilers-Fantini Online Game Performance Report, as International Game Technology topples Design Works Gaming in the overall charts.

This latter point saw Blackjack relegate DWG’s Break The Bounty to second, with L&W’s 88 Fortunes complementing its slots lead with a third placed finish overall.

An array of new entrants include DWG’s Piggy Payouts Bank Buster and Ainsworth’s Rise of The Dragon, with Space Invaders by Inspired and the Fa Fa Babies slot by Evolution’s Red Tiger also becoming fresh faces in 17th and 25th, respectively.

As this concluding pair follow this up with placings at 12th and 18th in the slots charts, Evolution’s Big Time Gaming sits directly behind the aforementioned leader in second and third with Bonanza and Extra Chilli.

Top Game Ranks – Slots

On a gross gaming revenue breakdown of slots suppliers, Evolution does indeed lead the way with a 30.2 per cent total ahead of IGT (24.1 per cent) and L&W (17.3 per cent).

“IGT continued to lead table games and video poker with Blackjack and Game King Poker, while Inspired Gaming Group led virtual sports, Design Works Gaming had the top performing instant win game with Break the Bounty, Pixiu Gaming had the top ranking bingo/keno game with Lucky 8 Keno.”

An enhanced position of dominance has also been evidenced by slots in this latest report, after accounting for 90.1 per cent of all games tracked, up from 89.9 per cent and 88 per cent during March and February.

This, once again, comes out ahead of table games’ 4.9 per cent (March: 5.1 per cent), live casino with 1.9 per cent (March: two per cent), video poker which remains consistent once more at 1.7 per cent, instant win’s 0.8 per cent (March: 0.7 per cent) virtual sports’ 0.2 per cent (March: 0.2 per cent), lottery with 0.3 per cent (March: 0.3 per cent), and bingo/keno which rises slightly to 0.2 per cent.

Evolution gains a further top spot by retaining its place at the summit of the ‘Supplier Mix by Game Category’ breakdown after accounting for 24.6 per cent (March: 22.4 per cent) of all games tracked, 88 per cent of which were slots.

The rebranded L&W and IGT again followed in second and third with similar figures month-on-month, accounting for 21 per cent and 15.1 per cent of all games with 88 per cent and 84 per cent being slots. High 5, Everi, Inspired and Ainsworth followed.

“We continue to see new suppliers emerge into the North American Market now tracking 27 unique suppliers across the 28 casino sites in the US,” Eckert continued.

“While Evolution, Light & Wonder, and IGT continue to dominate the games tracked collectively accounting for over 60 per cent of the games, we have recently witnessed emerging suppliers eat into market share and produce top performing games. 

“Last month we highlighted the instant win games From Design Works Gaming which continue to produce solid revenues for operators, but this month we get highlights from Pixiu Gaming with their Lucky 8 Keno ranking atop the Bingo/Keno segment, Inspired’s Space Invaders entering our database in the top 10 ranking slots themes, and Ainsworth’s Rise of The Dragon narrowly missing the top 10 slots after coming in at number 12 in our formal rankings. 

“As our database continues to grow and expand we will specifically segment NEW Games in our monthly report from games that have been in the market longer.”

Mobile maintains its frontrunning status with the highest percentage of theo win generated at 63.6 per cent (February: 62.2 per cent), leading the way in slots, table games, live casino, lottery, instant win, virtual sports, and bingo/keno.

Desktop is reported as producing a theo win of 33 per cent (February: 34.1 per cent) and forges ahead in the video poker category, the sole vertical not dominated by mobile during the month. Tablet lags behind with a theo win of 3.5 per cent (March: 3.7 per cent).

The Eilers-Fantini report collects monthly game performance data directly from online operators to track how games perform in the region’s igaming ecosystem, with an ambition of growing the database similarly to that of its land-based game performance index.

This latest analysis examines data from 28 online casino sites, across Connecticut, New Jersey, Pennsylvania, Michigan, and West Virginia, tracking 29,568 games to represent 57 per cent of the market in terms of gross gaming revenue.

Nevada’s Legends Bay Casino Resort is to officially swing open its doors to the public for the first time next month, with the first gaming facility built from the ground up in Reno-Sparks since 1995 to debut on August 30.

Pariplay has disclosed the latest addition to its Fusion aggregation platform after the NeoGames subsidiary added the SmartSoft Gaming content portfolio.

Legends Bay Casino Resort has received final approval from the Nevada Gaming Commission to begin operations ahead of an anticipated debut later this summer.

The gaming and entertainment facility, which will be the first casino built from the ground up in Reno-Sparks since 1995, promises to deliver “next-level gaming, dining, and entertainment experiences to northern Nevada” that is says will “showcase the latest slots, video poker, table games, and original dining and bar concepts”.

BOS, the Swedish trade association for online gambling, welcomed proposals from the country’s Moderate Party that will split and divest a section of Svenska Spel should they come to power during September’s elections.

An intention to overhaul the country’s current gambling legislation has been outlined by the Moderates, with a headline measure to see the state owned gambling group split into two separate entities for monopoly gaming (lottery and keno) and competitive gaming (gambling units and sports betting). 

All proposals submitted have been supported by the Riksdag, the highest decision-making assembly in Sweden, except for that which calls for a reversal in the adjusted requirement for moderation in marketing.

The motion also calls for bonus regulation for online gaming to be liberalised, as well as urging the Spelinspektionen to develop a Spelpaus website to ensure that those who have shut themselves off from gambling receive help and support.

Furthermore, the Moderate Party stated that further proposals to counter match fixing are required, with it also suggested that an evaluation of the Gaming Act “and its consequences on the gaming market” should be conducted in two to three years time.

Blackstone moved one step closer to finalising its much publicised A$8.9bn (US$6.3bn) takeover of Crown Resorts after the Federal Court of Australia approved the proposed acquisition.

This represented the final regulatory hurdle for the purchase following rubber stamps being issued across the states of New South Wales, Victoria and Western Australia.

The acquisition of Crown by SS Silver II Pty, an entity owned by funds managed or advised by Blackstone and its affiliates, represents a price of A$13.10 cash per share.

Blackstone, which agreed to the takeover of the group in February, had made a number of acquisitive overtures during the course of many months.

The Securities and Exchange Commission announced insider trading charges against a former Penn National Gaming employee regarding the Pennsylvania headquartered firm’s $2bn cash and stock acquisition of Score Media and Gaming.

The complaint, filed in federal district court in Philadelphia, alleged that David Roda, who served as Senior Backend Architect and Director of Backend at PNG during a near three year stint, breached confidentiality duties  

It wass said that Roda learned in early July 2021 that a potential PNG takeover of Score Media and Gaming was on the cards, and was warned not to trade on that information.

However, 500 out-of-the-money call options were purchased in the days and weeks leading up to the announcement of the acquisition, with Roda also said to have tipped long-time friend Andrew Larkin, also charged by the SEC, who subsequently bought 375 Score Media shares.

According to the SEC’s complaint, the company’s stock price increased nearly 80 percent after the two companies publicly announced their deal, following which Roda and Larkin sold their holdings for profits of $560,762 and $5,602, respectively.

The US Supreme Court found in favour of two Native American tribes in a decades long legal battle regarding the permittance of certain gambling activities on tribal lands.

In a narrow 5-4 ruling, the decision of the nation’s highest court states that the Ysleta del Sur Pueblo Indian Tribe and Alabama-Coushatta Indian Tribes of Texas have the autonomy to allow electronic bingo gaming on their lands, regardless of state rules, in compliance with the Indian Gaming Regulatory Act.

However, despite finding that if a game isn’t prohibited within Texas the state cannot impose restrictions on tribes, Justice Neil Gorsuch, Associate Justice of the US Supreme Court, noted that this does permit any activity a tribe may choose.

Playtech announced that the sale of its Finalto financial services division to Gopher Investments, has gained the receipt of all required regulatory approvals.

The all-cash sale was approved by shareholders during a general meeting that was held on December 1, 2021, and also previously met a key condition of the ultimately doomed £2.7bn Aristocrat takeover.

California Governor Gavin Newsom rubber stamped a gaming compact alongside the Tejon Indian Tribe that could bring the development of a $600m casino complex alongside Hard Rock International.

With Newsom concurring with the US Department of the Interior’s determination to allow 320 acres of land to be placed in trust, the compact has moved onto California legislature for ratification.

The casino project, which will be situated on 320 acres of land, is located approximately 25 minutes south of Bakersfield and is expected to directly create over 1,000 construction and 2,000 permanent jobs.

It was previously suggested that plans for the Hard Rock managed entity would deliver a 165,000 square foot casino, 400 room hotel, 13 restaurants, RV park, entertainment venue, spa fitness centre and convention space.

BOS, the Swedish trade association for online gambling, has welcomed proposals from the country’s Moderate Party that will split and divest a section of Svenska Spel should they come to power during September’s elections.

An intention to overhaul the country’s current gambling legislation has been outlined by the Moderates, with a headline measure to see the state owned gambling group split into two separate entities for monopoly gaming (lottery and keno) and competitive gaming (gambling units and sports betting). 

All proposals submitted have been supported by the Riksdag, the highest decision-making assembly in Sweden, except for that which calls for a reversal in the adjusted requirement for moderation in marketing.

“There is a risk of further eroding the regulated market if the players who have redeemed a licence, pay Swedish tax and maintain a high level of consumer protection do not have the opportunity to market their products to a greater extent,” the proposal states.

“In addition, we believe it is too early to implement changes in the field of marketing as practice has just been established, which with the government’s proposal would no longer be valid.”

The motion also calls for bonus regulation for online gaming to be liberalised, as well as urging the Spelinspektionen to develop a Spelpaus website to ensure that those who have shut themselves off from gambling receive help and support.

Furthermore, the Moderate Party states that further proposals to counter match fixing are required, with it also suggested that an evaluation of the Gaming Act “and its consequences on the gaming market” should be conducted in two to three years time.

“With this statement from the Moderate Party I welcome the fact that the two largest parties in opposition now have been so clear about their intention to privatise the competitive part of state operator Svenska Spel, if they will form or support a new government after the September general elections in Sweden,” stated Gustaf Hoffstedt, secretary general of BOS. 

“To run a commercial gambling business is not appropriate for a state. A state shall set rules for commercial gambling companies and make sure the companies comply with these rules, rather than being an active player on the market itself.”

Design Works Gaming has soared up the ranks in the latest Eilers-Fantini Online Game Performance Report, joining fellow top performers from the likes of IGT, Evolution, and Light & Wonder.

The Scottsdale, Arizona, development studio has seen its Break The Bounty title leap from third to first place in the overall gaming rankings through March, edging out 88 Fortunes by Light & Wonder and IGT’s Blackjack.

Furthermore, DWG also sees its Flippin Rich slot sit fifth, with newly tracked games making the top 25 comprising Go Fish, 100x Ra, and Unlimited Blackjack by Inspired, L&W, and Evolution, respectively.

Top Game Ranks – overall

88 Fortunes climbed from second to top spot in the slots bracket, finishing narrowly ahead of the aforementioned Bonanza and Flippin Rich games for the second straight month.

IGT’s Blackjack and Blackjack Poker and Pairs sit first and third in the table games category, sandwiching the Blackjack offering of the Evolution gaming group.

Rick Eckert, managing director of slot performance and analytics at Eilers & Krejcik Gaming, said of the latest report: “Design Works Gaming has gained traction with instant win games the past couple months with Flippin Rich and Break the Bounty.

“Instant win titles, unlike slots, don’t have spinning reels that need to index symbols on lines and ways to generate wins, but as the name states instantly present the player with a win or loss. 

“That doesn’t mean these games lack volatility or multipliers, bonuses, and other key features; they just get to the point quicker which may appeal to a gambler looking for quick wins and losses without the emotion of waiting for trigger symbols, free games, and bonus rounds. 

“While these two titles are only tracked at a few online casinos currently they have soared into the top 10 overall rankings in the latest reports.” 

The report collects monthly game performance data directly from online operators to track how games perform in the region’s igaming ecosystem, with an ambition of growing the database similarly to that of its land-based game performance index.

This latest analysis examines data from 28 online casino sites, across Connecticut, New Jersey, Pennsylvania, Michigan, and West Virginia, tracking 28,731 games to represent 57 per cent of the market in terms of gross gaming revenue.

Slots’ dominant position in the US’ igaming ecosystem grows further still through March after accounting for 89.9 per cent of all games tracked, up from 88 per cent and 87.4 per cent during February and January.

This comes out ahead of table games’ 5.1 per cent (February: 5.2 per cent), live casino with two per cent (February: 1.4 per cent), video poker which remains consistent once more at 1.7 per cent, instant win’s 0.7 per cent (February: 2.7 per cent) virtual sports’ 0.2 per cent (February: 0.6 per cent), lottery with 0.3 per cent (February: 0.4 per cent), and bingo/keno which once again rounds things off with 0.1 per cent.

Evolution retains its place at the summit of the ‘Supplier Mix by Game Category’ breakdown, after accounting for 22.4 per cent of all games tracked with 87.1 per cent of those being slots.

The rebranded L&W and IGT followed in second and third once more, with it reported that they accounted for 21.3 per cent and 15.1 per cent of all games and 88.5 per cent and 84.1 per cent of those were also slots.

High 5, Everi, and Ainsworth followed-up with 7.7, per cent, 5.8 per cent, and 3.9 per cent, respectively, all of which were slots. 

On a device basis, mobile maintains its frontrunning status with the highest percentage of theo win generated at 62.2 per cent (February: 58.8 per cent), leading the way in slots, table games, live casino, instant win, and virtual sports.

Desktop tracks a theo win of 34.1 per cent (February: 36.7 per cent) and forges ahead in the bingo/keno and video poker categories, with tablet, which soared to the front in lottery, lagging behind at 3.7 per cent (February: 4.5 per cent).

March has also seen Android lose its leading position in the percentage of total theo win in the mobile category, with iOS ahead 61.6 per cent to 38.4 per cent. iOS also dominates the tablet space once more after remaining consistent on 89.7 per cent.
