Sweepstakes casinos are rapidly retreating from the US market as a growing number of states are ramping up enforcement through cease-and-desist orders and passing legislation targeting the free-to-play, dual-currency model.

Idaho, Michigan, and Washington have long been ineligible jurisdictions for sweepstakes casinos, but in the past few months, several others have moved towards prohibition.

Montana was the first to officially ban the platforms at the end of May. Connecticut and New York followed in June, while Nevada granted its gambling regulators more authority to prosecute operators from out-of-state, including sweepstakes casinos.

Elsewhere, Louisiana lawmakers also passed a ban, but Gov. Jeff Landry vetoed it, stating it was unnecessary. Since then, the state has sent a cease-and-desist order to 40 offshore and sweepstakes operators, with many now starting to comply.

Additionally, Maryland, Delaware, and Mississippi are among the states employing the same regulatory tactic, issuing cease-and-desist letters.

State-by-State Breakdown: Sweepstakes Casino Exits and Holdouts

So, which platforms have complied? CasinoBeats has examined the terms and conditions of a sample of well-established sweepstakes brands.

Research conducted by CasinoBeats was accurate at the time of publication.

The study explicitly analyzed the terms and conditions, and which states are mentioned expressly as prohibited. CasinoBeats can not confirm whether each operator is applying its terms and conditions, and is aware that several other sweepstakes casinos may be operational in each individual state.

Montana

Every single sweepstakes casino that we’ve checked has now listed Montana as an ineligible jurisdiction.

The only exception is Luckybird.io, which continues to welcome players from Montana.

New York

Sweepstakes casinos exit New York as early as March, when a Senate bill advanced through committees.

At the beginning of June, New York Attorney General Letitia James announced that her office had shut down 26 platforms. That was followed by an official ban passed by the state legislature, pending Governor Kathy Hochul’s signature.

With that said, the following sweepstakes casinos no longer operate in New York:

Connecticut

While the Louisiana governor vetoed the sweepstakes ban bill, Connecticut Gov. Joe Lombardo signed the ban on June 5, joining Montana.

Since then, most platforms have been exiting similarly to New York and Montana, with a few exceptions.

Platforms that still accept Connecticut players include: Crown Coins, Fortune Coins, Funzpoints, Spinfinite, Sportzino, The Money Factory, Yay Casino, and Zula Casino.

Meanwhile, Luckybird.io, which serves New York and Montana, does not accept players from Connecticut.

Nevada

Nevada took a different approach from explicitly banning the platforms.

Instead, it passed a bill that gives state regulators more power to target and prosecute out-of-state operators without Nevada licenses who are operating illegally in the state, including sweepstakes casinos.

That has resulted in almost all platforms exiting the state. CasinoBeats has found at least four operators that do not explicitly prohibit players from Nevada from registering.

Maryland

Earlier this year, the Maryland Senate passed a bill banning sweepstakes, but the measure died in the House. Still, the Maryland Lottery and Gaming Control Agency has stepped up and targeted over a dozen platforms.

Some like VGW’s Chumba Casino have not complied, but others have. They include:

The reason for the governor’s veto on the sweepstakes ban bill in Louisiana is that he believed state gambling regulators and authorities could force the platforms out without legislation.

Soon after his veto, the Louisiana Gaming Control Board announced that it had targeted 40 unlicensed offshore and sweepstakes casinos.

While the regulator didn’t release names, the following platforms have now exited the state:

While Chumba has not complied, a few operators have chosen to leave:

  • Pulsz Casino and Pulsz Bingo (certain promotions)
  • Sidepot Casino

Delaware

The Delaware Division of Gaming Enforcement has been targeting sweepstakes casinos for over two years, albeit without much success initially.

In April, it announced it had served VGW’s LuckyLand Slots with a cease-and-desist order. Meanwhile, its sister site Chumba Casino was served almost two years ago. While it ignored the first order, VGW decided to withdraw from the state after receiving the April notice.

Louisiana and Nevada could soon join Montana in officially banning sweepstakes casinos. 

Ban bills in both states have passed through the legislature and now await the governor’s signature. Once each governor signs it, the bans will become official.

Different Approach to Targeting Sweepstakes Casinos

On June 2, the Louisiana House passed Senate Bill 181 unanimously, echoing the Senate vote at the end of April.

The bill classifies devices or platforms that use dual-currency payment systems as illegal gambling. The ban covers casino-style games, including slots, lottery games, and sports wagering. It calls for violation penalties of $10,000 to $100,000 and prison sentences of up to five years.

If Louisiana Governor Jeff Landry signs Senate Bill 181 into law, it will take effect on August 1.

Sweepstakes advocate, the Social & Promotional Games Association has lambasted Louisiana’s decision, accusing lawmakers of conflating legal entertainment with illegal gambling.

In a brief statement, the SPGA claims the decision “threatens Louisiana’s economy by stifling innovation and driving compliant companies out of state.” 

The SPGA added: “It’s a step backward for consumer choice, lawful innovation and common sense.”  

Meanwhile, Nevada has taken a different approach. It does not target sweepstakes casinos explicitly, but it gives state regulators more power to target and prosecute out-of-state operators without Nevada licenses who are operating illegally.

Senate Bill 256 expands existing penalties under Nevada law to upgrade certain gambling offenses from misdemeanors to felonies. Violations will be penalized with fines of up to $50,000 and imprisonment for up to 10 years.

In addition, anyone found guilty of illegal gambling must forfeit all profits and gross receipts, with the funds redirected to Nevada’s General Fund.

Louisiana and Nevada Follow Montana’s Sweepstakes Lead

If the Nevada and Louisiana governors sign the ban bills into law, the two states will join Montana in banning sweepstakes casinos.

A few weeks ago, Big Sky Country made headlines as the first state to ban sweepstakes casinos. The passage of the law was also condemned by the SPGA. 

The association labeled the Montana law a “dangerous precedent,” which it deemed overly vague and potentially criminalizing legitimate promotional programs, such as Microsoft Rewards.

Montana sweepstakes casino players still have a few months to use up their available coins. The new law comes into effect on October 1.

Connecticut is Close Behind Louisiana and Nevada in Sweepstakes Ban

Connecticut is also on track to ban sweepstakes casinos. The state is just a formal step away from sending a ban bill to the governor’s desk.

On June 3, the House passed Senate Bill 1235, sending it back to the Senate for concurrence. Given that the last day of the 2025 Connecticut legislative session is June 4, the ban will likely move swiftly to the governor for a signature.

In addition to sweepstakes casinos, the bill will also ban lottery courier apps, such as Jackpocket. While available in over a dozen states, lottery couriers are unregulated in most.

By implementing a ban, Connecticut would follow Texas, where controversy surrounding two significant jackpot winnings via lottery couriers led to widespread scrutiny and moves to abolish the Texas Lottery Commission.

Status of Ban Efforts in Other States

Eight other states have proposed a ban on sweepstakes casinos in 2025, but several attempts have already failed.

Mississippi and Maryland Senates were the first two legislative chambers in the US to pass a ban. However, a disagreement with the House in the former and running out of time in the latter caused the bills to die.

In Arkansas, the bill sponsor withdrew the bill, while in Florida, two separate bills failed to pass the committee stage.

The Illinois legislative session ended on May 31 with the passage of a new sports betting tax. However, a bill to ban sweepstakes casinos also failed to make any progress.

New York is also nearing the end of its 2025 legislative session, which is scheduled to adjourn on June 12. There are two active ban bills in each chamber of the legislature. Both made movements but have stalled recently, so if they were to pass, lawmakers must move quickly.

Still, New York witnessed a mass exodus of sweepstakes casino operators anticipating a ban. Most recently, industry leader VGW ended sweepstakes play in the state, signaling a potential prohibition.

Two other states with a longer legislative session still have plenty of time to pass a ban. New Jersey and Ohio lawmakers adjourn on December 31. Ohio has a two-year session, meaning bills from this year carry over to the next.

Bragg Gaming Group

Holly Gagnon and Alex Spiro have been appointed to the Bragg Gaming Group board of directors, with the group lauding the addition of ‘specialist expertise’.

Gagnon is an experienced gaming industry CEO with over 29 years’ in the industry, and has held senior positions at the likes of Seneca Gaming Corporation, Caesars Entertainment Corporation, MGM Resorts International, and Harrah’s Entertainment.

Spiro, a former prosecutor and the former coordinator of a program for children with autism at McLean Hospital, Harvard Medical School’s psychiatric facility, is a litigator and investor and serves as chair of Glassbridge Enterprises.

“We’re extremely pleased that Holly and Alex have agreed to contribute their expertise to the Bragg board,” said Paul Godfrey, chair of the board at Bragg Gaming Group.

“Holly’s extensive experience in the North American gaming sector will be invaluable as we expand our footprint in the US, and Alex brings exceptional analytical and business leadership skills to the team. Their areas of expertise are strong complements to our current board.”

Full House Resorts

A series of management promotions have been outlined by Full House Resorts, with Angelika Truebner-Webb, the current executive director of finance of administration at Indiana’s Rising Star Casino Resort, to be elevated to the role of general manager, pending customary gaming approvals.

Furthermore, the same property is to also see James McCracken promoted to assistant general manager, as well as Ashlee Wilkerson to director of human resources.

Elsewhere, in the group’s Nevada segment, which consists of Grand Lodge Casino in Incline Village and Stockman’s Casino in Fallon, Cyndy Carter formerly director of finance, is to become assistant general manager.

Crown Resorts

Steve McCann is to become chief executive officer and managing director of Crown Resorts, subject to the receipt of probity and regulatory approvals.

McCann, currently CEO of real estate and investment group Lendlease Corporation, a role he has held for more than a decade, last year delayed his planned retirement to lead the group’s response to the COVID-19 pandemic, and will retire from the board on May 31 2021.

He will join from June 1, 2021, with Helen Coonan to continue to perform her executive responsibilities as interim executive chairman until approvals have been received, in order to ensure a smooth transition.

Coonan said: “Steve is a first-class appointment for Crown and the right person to embed the ongoing reforms necessary to restore regulatory and public confidence in our operations.

Alliance for Gambling Reform

The board of the Alliance for Gambling Reform has announced the appointment of Gordon Ramsay as the organisation’s new CEO.

Gordon brings a wealth of experience to the role, most recently as the ACT attorney-general from 2016-2020. While in government, Ramsay is lauded as championing a gambling reform agenda in the ACT, resulting in a more than 20 per cent reduction in poker machines, and substantial regulatory improvements that have laid the pathway for ongoing reform.

Kalshi scored a partial win in its legal battle with Nevada. A federal judge granted the predictive market’s request for a temporary restraining order and preliminary injunction against the Nevada Gaming Control Board (GCB).

Tuesday’s ruling by U.S. District Court Judge Andrew Gordon effectively allows Kalshi to keep offering its sports-related event contracts in Nevada as litigation continues.

The judge also rejected the board’s counterclaims, which sought its own temporary restraining order and an injunction to halt Kalshi’s operations in the Silver State immediately.

Kalshi CEO Tarek Mansour acknowledged the ruling on social media site X (formerly Twitter), saying he is “grateful for the court’s careful attention to this matter and recognition of Kalshi’s status as a CFTC-regulated exchange.“Onto the next step.”Up next: a status hearing on April 30. 

Kalshi Holding its Ground Following Suit

Kalshi sued gaming regulators in Nevada after receiving cease-and-desist orders on March 14—the first action taken against the predictive market at the state level. Since then, five other states—New Jersey, Illinois, Maryland, Ohio, and Montana—have served similar notices to Kalshi, Robinhood, and Crypto.com.

Because it is a federally regulated platform, Kalshi claims it is not required to follow state-by-state gambling regulations or taxation laws.

Similar to stock trading, Kalshi allows users to buy and sell contracts for real-world events, including the U.S. presidential election and the Super Bowl. Last month, it introduced single-game betting markets for the NCAA men’s and women’s basketball tournaments. Notably, those markets were available in all 50 states, not just those with legalized sports betting.

The company also partnered with Robinhood, launching a Kalshi-powered prediction market hub for the platform’s 25 million users. Crypto.com has also joined the sports event contract frenzy. Both Robinhood and Crypto.com have received similar cease-and-desist letters from state regulators. 

Speaking last Friday at TechCrunch’s StrictlyVC conference in San Francisco, Mansour said he’s “not necessarily very concerned” about ongoing legal threats from states like New Jersey and Nevada and that the Commodity Futures Trading Commission (CFTC) is Kalshi’s primary regulator.

“If the CFTC tells us to stop, we will absolutely stop,” he said. “If they don’t, then we won’t.”

Mansour has previously said that prediction markets such as Kalshi are “initially misunderstood.”

“They are the quintessential truth machines,” he wrote last month on X. “With trust in traditional institutions at an all-time low, people are turning to prediction markets at an astronomical pace. The growth of the ecosystem in the last year is a testament to how important they have become to the American people.”

The US Depart of Justice has issued a new Opinion on an interpretation of the 1961 Interstate Wire Act that could have far-reaching implications for real-money igaming operators stateside.

The Opinion, which runs to 23 pages, is dated November 2, 2018, and reverses a 2011 ruling that the Wire Act prohibited only interstate sports betting compacts. That 2011 Opinion itself arose due to apparent conflicts in the enforcement of the Wire Act, as interpreted, and the Unlawful Internet Gambling Enforcement Act of 2006, the terms of which were the grounds for a number of DOJ prosecutions.

The November 2 Opinion, entitled Reconsidering Whether the Wire Act Applies to Non-Sports Gambling, opens:

“This office concluded in 2011 that the prohibitions of [the Wire Act] are limited to sports gambling. Having been asked to reconsider, we now conclude that the statutory prohibitions are not uniformly limited to gambling on sporting events or contests.”

This represents a reversal of a reversal and typifies the difficulties the DOJ, regulators, law enforcement agencies and the industry have had in interpreting exactly what is permitted.

Indeed, the fresh interpretation of the “plain language” of the Wire Act, evidently overlooked by the 2011 Opinion, appears to hinge on the lack of single comma within a key passage of text.

The Opinion states that the DOJ’s Office of Legal Counsel does not “lightly depart from our precedent. But having reconsidered our conclusion, we now reach a different result.”

The Opinion also notes that:

“Reaching a contrary conclusion from our prior opinion will also make it more likely that the Executive Branch’s view of the law will be tested in the courts. Something the DOJ considers to be a key test of the decision to reverse the 2011 interpretation.

“Under our 2011 Opinion, the [DOJ] may not pursue non-sports-gambling related prosecutions under the Wire Act. But under the conclusion we adopt today, such prosecutions may proceed where appropriate, and courts may entertain challenges to the government’s view of the statute’s scope in such proceedings.”

The latest note also stresses that a reversal of the 2011 Opinion does not permit the continuance of activities that were deemed legal then but that are now interpreted as against the letter of the Wire Act:

“We acknowledge that some may have relied on the views expressed in our 2011 Opinion about what federal law permits. Some States, for example, began selling lottery tickets via the internet after the issuance of our 2011 Opinion.

“But in light of our conclusion about the plain language of the statute, we do not believe that such reliance interests are sufficient to justify continued adherence to the 2011 opinion.”

So what does all this mean for the nascent online gambling sector in the US? It is unclear, in short.

There are at present a handful of interstate online poker compacts in place, between Delaware, Nevada and New Jersey but, in truth, these are not significant in terms of the overall revenues generated by igaming, in New Jersey in particular.

As new, more populous states regulate real-money online gambling – Pennsylvania has already done so but is yet to launch – the potential growth could be limited by the interstate restriction in the latest Opinion.

As the DOJ’s Office of Legal Counsel itself suggests, the detail will be tested in the courts. At this stage, quite where the line will be ultimately be drawn is far from clear.

The Nevada Gaming Control Board’s latest financial update shows that the state recorded total gaming revenue of $15.6 billion in 2024, a new annual record.

The $15.61 billion recorded was a 0.55% increase year over year compared to 2023’s data. Gaming revenue recorded for the final quarter of calendar year 2024 (October through December) was $4.06 billion. 

The number of licensees that reported results across the year was 454, with 436 submitting data for December.

Slot machines were Nevada’s primary revenue driver in 2024, generating $10.52 billion, or 67.3% of total gaming revenue. This represented a yearly growth of 2.27%. The average win percentage across all denominations was 7.2%.  

The NGCB reported that there were 127,176 slot machines across the Silver State. 

Multi-Denomination Slots Surge as Single-Denomination Machines Decline

A breakdown by slot machine denomination shows a move from specific-denomination slots to multi-denomination machines:

  • 1-Cent Slots generated $2.37 billion, down 24.87% year-over-year;
  • 5-Cent Slots revenue was $35.3 million, a decrease of 17% when compared to 2023;
  • 25-Cent Slots dropped 17.86% to $180.6 million in revenue in 2024;
  • $1 Slots also fell by 17.26%, recording $528.0 million for 2024;
  • $5 Slots saw the most significant year-over-year fall by percentage, with a 24.78% decrease to $52.9 million;
  • $25 Slots generated $17.7 million, a decrease of 22.51% from 2023’s figure;
  • $100 slots reported the most minor decrease in single-denomination slots, dropping 8.72% to $29.1 million in revenue for 2024
  • Multi Denomination slots rose 19.77%, generating $7.15 billion of all slot-based revenue in 2024. 

Slot machine revenue was 73.6% of the renowned Las Vegas Strip’s gaming revenue in 2024. 

Within table games, Blackjack generated $1.34 billion in revenue, up 1.07% year-over-year. Baccarat generated slightly more, with $1.39 billion, but this was a 6.33% decrease in 2023’s reported revenue. Roulette revenue also decreased by 4.39%. 

Nevada sports betting revenue stagnated, only increasing by 0.17% yearly to $482 million. The channel shift continued in Nevada, with mobile sports betting driving 59.3% of the state’s total GGR. The $285.8 million mobile sports betting revenue increased by 18.82% yearly. 

Basketball betting revenue was the most significant compared to American football, baseball, and hockey, rising 14.3% year over year to $152.5 million. Baseball reported the most significant decrease, down 22.9% to $71.8 million for 2024.

The Nevada Gaming Commission has granted Kambi Group plc a license to begin operations within the state.

The Swedish company has been granted Manufacturer & Distributor Licenses and an Information Services License, enabling it to roll out its full B2B sportsbook offering in the Silver State. 

The Nevada Gaming Control Board unanimously recommended approving the licensing application in late January 2025. 

Nevada has long been seen as the pinnacle of the United States of America’s gambling regulation. It was the only place where sports betting was legal until the repeal of PASPA in 2018. Kambi entered the US immediately upon the shift in federal legislation, processing the first legal online wager outside of Nevada. 

Kambi’s Strategic Expansion in Nevada and Beyond

The grant of licenses allows Kambi to offer its solutions to brick-and-mortar locations on the world-renowned Las Vegas strip. The company hopes that given the stringent regulatory environment in the state, it will be optimally placed to capitalize on the lack of B2B competition and ‘expand its footprint across the Americas.’

Globally, Kambi boasts operator clients in over 50 jurisdictions, including 15 U.S. states where sports betting has been legalized and Canada’s Ontario. The company recently reported processing over one billion wagers each year. Earlier in January, Kirk Hendrick, Chairman of the Nevada Gaming Control Board, announced his resignation, which will take effect after the ongoing legislative session. His final day as chair will be determined and announced soon.

The Nevada Gaming Commission has delayed a decision of discipline towards the wife of an illegal Vegas bookmaker. The matter has since been tabled for a later date.

Nicole Bowyer, wife of convicted illegal bookmaker Mathew Bowyer, was the subject of a Thursday, January 30, 2025, hearing. She faces the potential of a five-year ban as a registered independent agent in the state. A settlement could not be agreed upon because commissioners wanted to hit her with stiffer penalties.

The Gaming Commission initially considered a settlement negotiated for Nicole Bowyer from the Nevada Gaming Control Board (NGCB). Bowyer herself was not present for the meeting. The commission heavily scrutinized a representative from the NGCB, as the details of the situation did not appear consistent among commissioners.

The proposed terms for Nicole Bowyer’s settlement were conditional on the defendant admitting everything listed in the complaint from the NGCB dated August 2024. Additionally to this, she would have her registration revoked for a minimum of five years as a consequence. It was said that Nicole Bowyer profited from the illicit gains from her husband. The full complaint details a list of factual allegations, such as her time as a personal host at Resorts World Las Vegas.

In August 2024, Mathew Bowyer pled guilty to running an illegal gambling business, as well as money laundering through false tax returns. He told the judge: “I was running an illegal gambling operation, laundering money through other people’s bank accounts.” He is due to be sentenced on February 7, 2025.

Nevada commissioners wanted more details about the couple’s activities for the ongoing investigation in which the Gaming Commission is directly involved. No fine was proposed at the meeting; however, it was said to be seeking a lifetime ban instead of a five-year ban. Nicole Bowyer had stated she would never want to re-enter the gaming industry in Nevada, but the commission wanted this in writing before a concrete decision could be made.

Nicole Bowyer’s defense was to blame her husband, Mathew Bowyer, claiming to be a pawn in his schemes, according to what she told investigators. According to her testimony, it was his idea for her to become a personal host at the Resorts World Las Vegas to help recoup house losses. Additionally, she claimed to have no knowledge of any anti-money laundering protocols that were enforced.

George Markantonis, a Nevada commissioner, described Nicole Bowyer’s reasoning as “flimsy, whimsical excuses” and reiterated how it was hard to “even remotely begin to believe that someone would not know” about anti-money laundering protocols, being in her position. Bowyer did not cooperate with the NGCB until she was given the opportunity for an extension to respond. No time frame has been provided for when the proposal will be resubmitted.
