UK broadcasting regulator Ofcom has highlighted a positive change in Twitch’s accuracy for labelling mature content after evaluating the streaming platform’s classification guidelines. 

In June 2023, Twitch updated its content classification guidelines after the platform witnessed an increasing amount of content targeted to mature audiences, including gambling streams. 

The platform applied new rules to the ways in which content is labelled, requiring streamers to apply content classification labels to indicate that the streaming content they are broadcasting contains certain mature themes. 

Streamers were given six mature labels to apply to their streams: mature-rated games; sexual themes; drugs, intoxication or excessive tobacco use; violent and graphic depictions; significant profanity or vulgarity; and gambling. 

As the UK’s regulator for video-sharing platforms and online safety, Ofcom published an evaluation of Twitch’s rule changes earlier this month. 

The 66-page report concluded that content labelling has improved “significantly” since the introduction of CCLs, while finding that viewing behaviour and the type of content being streamed on Twitch hasn’t been “materially altered”. 

The report stated: “Following the CCL change, we saw an increase in creators labelling mature content as mature. We also saw a decrease in mis-labelling of streams as mature. 

“Separately, our analysis established a causal link between the CCL change and an increase in creators accurately labelling mature content as mature.”

Gambling streams

Evaluating gambling streams specifically, Ofcom found that prior to the CCL change, around 65% of gambling streams were being accurately labelled as mature.

While the evaluation didn’t state the percentage of gambling streams being accurately labelled as mature following the changes, it did suggest there had been “a sharp jump” in accuracy after studying streams within 30-days of the CCL change. 

Twitch has continued to reduce the accessibility of mature content, particularly gambling streams, to under-18 audiences with updated rules and regulations. 

In 2022, the streaming platform banned streamers from broadcasting footage from a number of unlicensed gambling websites, including Stake.com, Rollbit.com, Duelbits.com and Roobet.com. 

More recently, Twitch introduced a new feature to allow viewers to block specific CCL categories when navigating through streams, acting as a default filter for underage viewers.

Twitch has introduced new features to give viewers more control over adult content on its live streaming platform.

On 21 May, Twitch announced an update titled “We’re giving viewers more control over their Twitch experience.” The platform aims to create a welcoming environment and acknowledges that some content may not be suitable for everyone.

The update includes new content filtering and thumbnail blurring options to hide ‘Content Classification Labels’ (CCLs) that mark adult themes/streams.

Last year, Twitch began using CCLs to help viewers make informed choices. The new content filtering option allows users to exclude streams from specific CCL categories.

Viewers can find new filters in the ‘Content Display Preferences’ section of ‘Profile Settings.’

The filter lets viewers hide CCLs categorized as Sexual Themes, Drugs/Intoxication, Gambling, Violent & Graphic Depictions, Significant Profanity, and Mature Rated Games.

Users under 18 will have default filters for all CCL themes except Mature Rated Games. Logged-out viewers will have default filters for Sexual Themes and Gambling.

Guidelines state: “Streams labeled with CCLs you have chosen to filter out will not be recommended to you, and will not show up as you browse categories or search for content. If you follow a streamer, their content will be exempt from these settings and will always be shown, even if labeled with a CCL that you’ve chosen to filter out.”

The option to blur thumbnails is applied to content labelled with Sexual Themes CCL by default. Followed channels are exempt from blurred thumbnails.

The update warns content creators about tougher enforcement of CCLs. Repeated failure to correctly label streams will lead to a permanent label being applied to the channel.

Streamers should read Twitch guidelines to understand how to apply CCLs for adult content. In 2022, Twitch updated its community guidelines to ban streamers from promoting gambling content.

Twitch prohibits streaming gambling sites offering slots, roulette, or dice games unless they are licensed in the US or other jurisdictions with adequate consumer protection.

In August 2023, Twitch implemented an outright ban on all livestreams of gambling content to protect audiences from the predatory marketing of unlicensed gambling websites. The update specifically banned the online casinos of Blaze and Gamdom, targeting audiences directly.

The UK Gambling Commission has published its Corporate Strategy 2024 to 2027, explaining the key areas of the British gambling market that the regulator will focus on over the next three years.

The strategy – ‘Gambling regulation in a digital age’ – is part of the UKGC’s commitment to delivering the proposals set out within the UK Government’s White Paper ‘High stakes – Gambling reform for the digital age’.

 It highlighted five key areas for the next three-year period: using data and analytics to make gambling regulation more effective; enhancing core operational functions; setting clear evidence-based requirements for licensees; being proactive and addressing issues at the earliest opportunity; and regulating a successful National Lottery.

“Our new three-year strategy ‘Gambling regulation in a digital age’ sets out how we will deliver the reforms set out in the Government’s gambling white paper, and successfully regulate the National Lottery under a new licensee,” commented Marcus Boyle, Chair of the UKGC.

Kansspelautoriteit, the Dutch gaming authority, has issued an order subject to a penalty on Casbit Group NV for offering games of chance without a licence.

The KSA stated that it informed Casbit at an earlier stage that it intended to impose an order subject to a penalty on the operator for illegal games of chance on its lala.bet website.

Casbit responded by removing accessibility to its website for players in the Netherlands, but upon re-inspection, the authority claims the website is still accessible in the country, so a penalty has been imposed.

With the order subject to penalty, KSA has called on Casbit to immediately stop the illegal offering, with a penalty of €280,000 per week with a maximum of €840,000 being imposed if this is not complied with.

Inspired has provided an update to its investors after it received an expected notification letter from the Nasdaq over non-compliance due to not having timely filed its Form 10-K for last year. 

The gaming firm revealed that it will report financial results for the fourth quarter and the 2023 on Monday, April 15, 2024, before the market opens. 

The current update from Nasdaq doesn’t have any immediate effect on the listing of the Company’s common stock on Nasdaq. 

Nasdaq, if it agrees to, can grant Inspired an exception of up to 180 calendar days from the filing’s due date, or until September 11, 2024, to regain compliance. However, if the firm fails to publish its accounts by this date, it may be delisted from the exchange.

A co-commissioned study by the Alcohol and Gaming Commission of Ontario and iGaming Ontario has found that 86.4 per cent of online gamblers in Ontario prefer to wager in the regulated igaming market.

Conducted by Ipsos in February this year, the study interviewed 2,016 Ontarians aged over 19, including a general population sample of 1,009 and an additional sample boost of 1,007 who had gambled or wagered real money bets online in the past three months.

Ipsos noted that “quotas and weighting were employed to ensure that the general population sample’s composition reflects that of the Ontario population according to census parameters”, which resulted in a total sample of 1,299 Ontarians who gambled or wagered real money bets online in the past three months. 

The study found that 86.4 per cent of Ontarians who wager online did so with regulated operators in the past three months. In a similar study conducted in 2023, this figure stood at 85.3 per cent.

However, the study also discovered that 19.9 per cent of those who had gambled online during the three months wagered on regulated and unregulated sites. Meanwhile, 13.6 per cent of those surveyed wagered solely on unregulated sites in the same period.

As of April 4, the Ontario igaming market has 47 registered operators and 77 regulated websites.

Dr Karin Schnarr, Chief Executive Officer and Registrar of the AGCO, commented: “In Ontario, regulated sites are held to high standards of game integrity, data security and player protections, including having significant responsible gaming safeguards. 

“While it’s encouraging to see most participants are choosing regulated gaming options, those who are not are unfortunately risking far more than their wagers.”

A bill has been introduced in the New Jersey Senate that would increase the tax rate for online casino and sports betting operators in the US state.

Sponsored by Senator John McKeon, S3064 seeks to increase the annual tax on igaming and online sports betting gross revenues to 30 per cent, up from the current rate of 15 per cent and 13 per cent respectively.

S3064 was first reported back in March, but now it has been introduced in the New Jersey Senate, where it has been referred to the Senate State Government, Wagering, Tourism and Historic Preservation Committee.

The current igaming tax rate for operators in the Garden State is split as 15 per cent tax to the Casino Revenue Fund, plus an additional 2.5 per cent to the Casino Reinvestment Development Authority.

Under S3064, only an additional 1.25 per cent would go to the Casino Reinvestment Development Authority.

A rise in the tax rate would bring New Jersey in line with some of its neighbouring states such as Pennsylvania, which has a 54 per cent tax rate for online slots and a 16 per cent tax rate for table games and poker.

After a myriad of delays, the Senate of Brazil did approve the ‘basic text’ of Bill 3626/2023, however, the bill will be subject to further analysis. 

Nonetheless, the Senate detailed it has upheld an appeal by Liberal Party Senator Carlos Portinho (RJ) to exclude online casino modalities from the legislation.

It continued a period of indecision when it came to online casinos, as the sector failed to enjoy the same progress as sports betting in the region.

GamCare research has highlighted a connection between cryptocurrency investing and gambling, as people suffering from harm in either vertical experience similar difficulties.

The UK gambling charity noted that 200 calls were received by the National Gambling Helpline over the past two years from people who stated they were struggling with online financial markets, including cryptocurrencies.

Calls included “accounts of people losing over £50,000 through their trading, and young adults who spent mortgage deposits on cryptocurrency but ultimately lost large amounts of money to it”.

XLMedia has published a pre-close trading update for 2023, noting that it has explored possibly selling the whole company but has been unable to find suitable value for its assets.

In addition, the company’s North American revenues for the year are expected to finish strong but below previous forecasts, group revenues to be between $50m and $52m, while adjusted EBITDA is expected to be in the range of $12m to $14m.

Regarding M&A activity, XLMedia noted that following the sale of three European casino assets in July, the company’s board is exploring further asset sales opportunities and has had early talks with potential purchasers.

However, the board stated that there is “no certainty that any sales will be completed”.

XLMedia has also explored the possibility of selling the entire company over the past couple of months. While there has been a “demand for the assets”, a sale of the whole company is “unlikely to create the most value for shareholders”.

The company added that no discussions are currently ongoing regarding a sale, so the board “does not plan to undertake the sale of the whole company at this time”.

Colombia’s Federal Gambling Authority, Coljuegos, has revealed plans to overhaul the rules on owning and operating electronic slot machines in the nation. 

Via the ‘regulatory project’, Coljuegos plans to initiate the changes in 2024 in a move deemed critical as the regulator aims to reduce illicit activity in the form of unauthorised ESMs across the country’s 32 federal territories. 

Colombia’s regulatory overhaul for slot machines is accompanied by a ‘public comment period’, which will run until December 14 to allow industry stakeholders and interested parties to submit feedback on initial proposals.

According to the authority, the project will promote “territorial development with the replacement of illegal economies with legal ones, considering the productive capacities of intervened areas.”

Blackpool MP Scott Benton has been suspended from Parliament for 35 days following a standards committee report accusing the MP of corruption.

A streamer has been issued a fine in Denmark for advertising illegal gambling, which becomes the first instance that such a case has been reported by the nation’s gambling authority, Spillemyndigheden.

This has seen the individual in question, who was unnamed by the regulator, accept a fine of DKK 10,000 (£1,153) for advertising unlicensed gambling providers via Twitch

Earlier this year, the Danish Gambling Authority noted that it had discovered that the streamer advertised the unlicensed sites, and subsequently reported the streamer to the police.

Following an assessment on if the streamer had violated the law, a fine for the aforementioned figure was issued, which was the amount recommended by the regulator

This represents the first time the DGA has reported a streamer in a case regarding illegal gambling advertisement. 

Yesterday, the Authority undertook further action against illegal activities after successfully petitioning the district court to have 49 websites offering illegal gambling in the country blocked.

Those in question were reportedly primarily offering traditional casino games, such as roulette, gaming machines and poker, as well as betting. 13 were skin betting websites.

This is the ninth time that the Authority has gone to court to block illegal websites, with these activities now being undertaken twice per year as opposed to on an annual basis.

Since 2012, when the gambling market in Denmark was partially liberalised, a total of 276 illegal sites have been blocked.

The decision to close the FOX Bet platform is being undertaken over the course of the next month, with a phasing out of operations to begin today (Monday 31 July) and last under August 31, 2023.

As a result, Flutter, which operated FOX Bet as part of the Stars Group, will retain ownership of PokerStars, in addition to one of the leading lights of the US’ sports betting space in FanDuel.

FOX will hold the right for all future usage of the FOX and FOX Bet brands, including FOX Bet Super 6, and intends to launch a new game associated with the latter later this summer.

888 is looking to make further “significant” progress across the African continent after its part-owned 888AFRICA entity detailed the purchase of BetLion to accelerate “huge ambitions”.

The online casino and sports betting operator is currently licensed in Kenya, Zambia and the Democratic Republic of the Congo, and is headquartered in Nairobi, the capital city of the former. This adds a further hub for 888AFRICA, building on an existing base in Dar es Salaam, Tanzania.

Through the addition, 888 is expecting to drive further scale in the business, as well as deliver a notable number of new customers. BetLion counts more than three million registered users.

Catena Media initiated a €6m sale of its UK and Australian online sports betting brands amid an ongoing focus on the North American online sportsbook and casino affiliation market and business wide strategic review. 

The divestment to sports betting affiliate Moneta Communications, which itself was purchased by Seven Star Digital last year, marks “a further step forward” in refocusing the business for the aforementioned market.

Star Entertainment added to a lengthy list of financial penalties after being found guilty of 11 offences and being ordered to pay a A$140,000 sanction.

Following an investigation by Queensland’s Office of Liquor and Gaming Regulation, the embattled casino operator had entered a guilty plea in the Brisbane Magistrates Court earlier in the year.

Everton FC is to step onto the realm of streaming and esports after teaming-up with KICK, which will become an official sleeve and streaming partner of the club.

This will see the logo of the platform, launched in October 2022 as a competitor to Amazon-backed Twitch, be featured on the shirt sleeves of Everton’s senior men, women and under-21s teams.
